If you have only set up a single group, the default contact for this group will receive the dailymail. If you have set up multiple groups, you can specify which group is to be the default group for collective debt settlement files by ticking your preferred option. You can do so in the user management settings. Once done, the default contact for the group you selected will receive the dailymail with the overview of all invitations for collective debt settlement files.
No. All users of an account in the public section can see an overview of all files the account has received an invitation for in the 'Actions to be taken' table.
No. You have the option to either accept the invitation, transfer it, or reject it.
Yes. As in RegSol, a dailymail will be sent to the default contact of the group managing the file.
All other users can also receive a daily message with the notifications if they have ticked that option in the user management settings.
You will receive a digital notification when you are involved in a collective debt settlement file in a specific capacity, when you have an account for the public section, and when you have given permission for your data to be used by the JustRestart database.
Yes. If you wish to do so, you will need to prepare two debt claims.
- One debt claim for the part you wish to retain. You can submit this as normal.
- A second debt claim for the part you wish to sell. You can fill in the basic details of this claim and store it as a draft (without submitting it). Once you have stored your draft claim, you can transfer this debt to a different account. This other account will then be invited to the file, and will instantly be listed as a creditor on this second claim.
There are two methods for transferring a file to another account:
- 'Transfer': This option is the same as transferring a file to a different account, with the other account taking your place as a creditor. If you choose this option, you will no longer be listed as a creditor, meaning you will no longer have access to the file.
- 'Pass file onto authorised party': If you choose this option, you effectively invite another party to the file as your representative (e.g. a lawyer), and both parties will have equal access to the file. As such, you will still be able to view all documents, submit an extra debt claim, issue your opinion on a draft amicable recovery settlement etc.
In the first phase, no option has been built into the public section to 'withdraw' access. If this does need to be done, you will need to contact the registrar to block access for the other account.
PRIVATE
Once you have logged into the private section, you will be taken to the private section dashboard. An overview of all files in which you have been appointed as a debt mediator can be found under the red 'My collective debt settlements' tile.
Yes, although you can only do so when they have an account in the public section, and after they have been linked to the relevant file.
Possibly. Natural persons and foreign legal entities are under no obligation to use the database. In these cases, it is up to you as a debt mediator to convert these debt claims into an electronic format. You can do so using the green 'debt claims' tile on the home page of each file.
No, if you wish to use the database, an annual fee is payable per file. This fee will be collected on the anniversary of the decision on whether or not the file is admissible.
No. This option is not yet available. However, you can download an Excel file with an overview of debt claims under the green 'debt claims' tile on the home page of each file. You can then draw up your settlement outside of JustRestart on the basis of that Excel file.
Go to your profile in the private section. Click on “Modify user”. You can add, per department, the company number in the field “company number”.
Attention : As debt intermediary, you are responsible for the data in your account, consequently also in this specific field. These data are the basis for the preparation of the retribution debit note.
