CSAM is the gateway to a whole host of public services. Whenever you log in to applications associated with the Belgian government, you always access these applications using CSAM. This system guarantees a high level of security.

  • Logging in to RegSol using CSAM = strong authentication.
  • Logging in to RegSol without using CSAM = weak authentication.

Attorneys accessing regsol.be using their attorney card will also be using strong authentication.
 

You log in with weak authentication by using your e-mail address and password.
 
What can you do once you are logged in with weak authentication? 
You will be unable to perform certain actions. The action buttons associated with weak authentication are coloured blue. The action buttons that require strong authentication are coloured grey. The table below provides further information about the actions you can perform.

To log in with strong authentication, you must first link your national register number or your lawyer’s card number to your account. You will only need to do this once. Follow the steps below:

  • Go to regsol.be and log in with your e-mail address and password
  • Click on your e-mail address at the top right
  • Go to “User management” 
  • Click on the blue “Change” button under the “Personal information” section
  • Click on “Get NRNR” or “Read lawyer’s card number”
     
  1. For a one-time strong link with your NRNR  you will be redirected to CSAM where you must enter your PIN code
  2. For a one-time strong link with your lawyer’s card number you will be redirected to Zetes where you must enter your PIN code
     
  • Once your NRNR or lawyer’s card number has been linked, a green check mark will appear next to the number
  • To complete strong authentication, you must: log out and log back in again. NB: this time you do this with your e-ID, Itsme or lawyer’s card
     

Log in with strong authentication by using your e-ID, Itsme or lawyer’s card. The proviso here is that you have previously linked your national register number or lawyer’s card number successfully to your account on regsol.be.

When logging in to regsol.be, choose one of the following buttons. 
 

Login

The regsol.be actions in question are as follows:

For bankruptcies:

  • Filing (or preparing) a declaration of bankruptcy, as the debtor or as an adviser of the debtor
  • Adding an item to the timeline of an ongoing bankruptcy case, as the debtor or as an adviser of the debtor

 
For Judicial Reorganisation Procedures:

  • Filing (or preparing) a request for a Judicial reorganisation procedure, as the debtor or as an adviser of the debtor
  • Performing actions under the “Debt claims” tab, as the debtor or as an adviser of the debtor
  • Adding a document/article to the timeline of an ongoing case, as the debtor or as an advisor of the debtor
  • Filing a request for voluntary intervention, as a third party or as an advisor of a third party
  • Filing a request to dispute or include a debt claim, as a creditor or as an advisor of a creditor


 For a file transfer under judicial authority:

  • Filing a request for transfer under judicial authority
  • Adding an item to the timeline of the file

 
For a file with amicable settlement out of court:

  • Filing a request for approval of an amicable settlement out of court
  • Adding an item to the timeline of the file

When you have linked your NRNR or lawyer’s card number to your account, you will see a green check mark next to the number. You are currently not yet logged in with strong authentication. You logged in with weak authentication to link your number or card. 

You must now log out again and log back in with strong authentication. Proceed as follows:

  • Click on your e-mail address at the top right and then on “Log out”
  • Log back in again, this time using your e-ID, Itsme or dp-a lawyer’s card
  • You are logged in with strong authentication when all the action buttons on your dashboard are blue

 

To log in to regsol.be with strong authentication in the future, use your e-ID, Itsme or lawyer’s card.
 

Strong authentication can only be performed on the basis of a Belgian national register number or BIS number. 

If you do not have these numbers and would still like to perform an action on regsol.be that requires strong authentication, it is best to contact a Belgian attorney who can perform these actions for you.

If different people or different departments of your organisation work in regsol.be, you can organise your organisation's account in groups. People assigned to the same group can see each other’s files and therefore follow up. 

If you wish to set up such a structure, you will need an account administrator (at least 1). This "Account admin" designates a "Group admin" for each group. This means a user (an individual within your organisation) can work within a group (e.g. your company’s accounting department), while your account can consist of different groups. 

In concrete terms, you can build in the following levels:

  • An account (with at least one account administrator)
  • A group (with at least one group administrator)
  • Users

 User-levels 

When you create the account, a (first) group is immediately created with the same name as the account. You also become the first user of this group and are therefore the account administrator (Account admin), group administrator (Group admin) and default contact person (read more). 

To allow several people from your organisation to work within the same account, as an Account admin, proceed as follows:

First add a user to your account

  • Click on your e-mail address at the top right and then go to “User management”
  • Go to the “Users” tab and click on “Add new user” 
  • You can also use this tab to remove users. To do this, click on the pen underneath the column  "Actions" next to the user's name and then click "Remove from group"

 
 
Appoint the account administrator 

By default, the person (i.e. the user or e-mail address) who creates the account in regsol.be also becomes the Account admin. Only an Account administrator can add or remove another Account admin.

To add or remove an Account admin, proceed as follows:

  • Click on your e-mail address at the top right and then go to “User management”
  • Click the "Change admin" button in the box on the right, under the "Account admin" section, 
  • The list of added users opens. Select the user whom you want to designate as Account admin
  • You can remove an Account admin in the same box by clicking on the trash can. 

 
Add a group (or multiple groups) to your account

  • In your “User Management”, click on the “Groups” tab
  • Click on the blue “Add new group” button


Important: only an account administrator can create new groups.

 

Adding a user to the group

Once a person has been added to your account as a user, he/she can be assigned to a group.
A person can be a member of several groups.

Important: only an account administrator can add new users. A group administrator, the manager of a group, can add existing users to his/her group.

  • In “User management”, go to the “Groups” tab
  • In your overview of groups, click on the pin under “Actions”
  • Under the “Users” section, click on “Add new user”
  • You can also remove a user from the group in the same box by clicking on the trash can
     

Determine the rights of the user within the group

  • In “User management”, go to the “Groups” tab. Select the “Actions” button for the relevant group
  • You can modify the rights by clicking the buttons under the "Users" section, in the "Rights" column. When the button is green, it means the right has been granted. When the button is red, the user does not have the right.

    Button 3: submit a new insolvency procedure (a declaration of bankruptcy, a petition for a judicial reorganisation procedure, a petition for transfer under judicial authority or a petition for homologation of an amicable settlement)

  • 1 user must always be checked under the "Default contact person" section. Such user will receive a direct communication from the RegSol platform if so desired. 

 

The necessary rights and duties are always enforced via the platform. Namely, it is necessary that:

  • each account has an account admin 
  • each group has a group admin and default contact person

These types of users will be created automatically when you create a new account or group. RegSol will ensure that you can immediately start using your new account or group properly. It is always possible for the account or group admin to change all these rights, as described above.

However, users cannot be removed if, as a result, the above obligations can no longer be met. For example, it is not possible to delete the last group admin, as the group in question can no longer be managed at that time. RegSol will therefore not allow these actions. 

Regsol.be has been developed for use on a computer or laptop and does not support mobile devices such as a smartphone or tablet. 

You can only search for open files in the register. If you search for a file that has already been closed, you will not see any search results.

You will only be able to find a now closed file in the “My Files” list on regsol.be if you previously had access rights. Check the option: “Also search in closed files” for this type of search.
 


 

Anyone can request access to an open file. Access can only be granted to the extent that you are a creditor or interested third party in accordance with the categories stated by law and/or Royal Decree. To do this, search for the file in question by clicking on “Request to access a pending file” on the dashboard. Then look for the relevant file and click on it. On the file’s “General information” page, click one of the blue action buttons to access the file. You must clearly state in which capacity you are requesting access because this also determines what rights you will be granted in the file. Your access request will be assessed depending on the nature of the procedure:

Bankruptcy

  • Bankruptcy before 1 May 2018: The receiver
  • Bankruptcy after 1 May 2018: The bankruptcy judge
  • As the debtor’s lawyer: your client/debtor will grant you access. If the debtor does not have access to the file on regsol.be, the bankruptcy judge will process your application

 

Public judicial reorganisation procedure

  • You are a creditor, employee or employee representative: The debtor (or his/her counsel)
  • You are a different party than the above: The delegated judge
  • You are the debtor’s lawyer: your client/debtor will grant you access. If the debtor does not have access to the file on regsol.be, the delegated judge will process your application

 

Transfer Under Judicial Authority

  • You are a creditor, employee or employee representative: The debtor (or his/her counsel)
  • You are a different party than the above: The delegated judge
  • You are the debtor’s lawyer: your client/debtor will grant you access. If the debtor does not have access to the file on regsol.be, the delegated judge will process your application

You will receive a personal e-mail and a notification as soon as your access has been granted. If access is denied, you will be informed of the reason in the notification and e-mail.

Your access request to a file must always be processed by a different user. It may therefore take a few days before a decision is made on your access application. To follow up on the status of your access request, contact the following actors on the file:r:

Bankruptcy

  • Bankruptcy before 1 May 2018: the receiver 
  • Bankruptcy after 1 May 2018: the bankruptcy judge

 

Judicial reorganisation procedure

  • Judicial reorganisation procedure with opening judgement before 1 September 2023: the delegated judge
  • Public judicial reorganisation procedure: the delegated judge

 

Transfer under judicial authority

  • Transfer under judicial authority: the delegated judge

If you realise that you have been granted access to a file in the wrong capacity, please contact the file access manager. 

These are:

  • For a bankruptcy before 1 May 2018: the receiver
  • For bankruptcy after 1 May 2018: the bankruptcy judge
  • A judicial reorganisation procedure or transfer: the delegated judge
     

You can address them via the messaging module to request denial or removal of your existing access to the file. Once this has been arranged, request access to the file again via regsol.be, this time in the correct capacity. This is identical to the procedure you followed previously. 

Should you be the petitioner of this file, you are not able to change your status. Contact our helpdesk in this instance. To do this, click on the icon to the right of your e-mail address on regsol.be. 
 

You will no longer be able to view a file via the public section if you did not have access to that file before it was closed.

If you do wish to access a closed file, please contact the registry at the Corporate Court in question by e-mail. Contact details for the (insolvency) registry’s offices can be found on the Courts and Tribunals website https://www.rechtbanken-tribunaux.be/nl or https://www.rechtbanken-tribunaux.be/fr. The clerk can grant access by inviting you to view the file. 

To assess your request, the registrar will need the following information from you:

  • surname
  • first name
  • national registry number 
  • address 
  • e-mail address 
  • company name (if applicable)
  • any differing trading names (if applicable)
  • company legal form (if applicable)
  • company number (if applicable)
  • company address (if applicable)

 
As such, please make sure you include this information in your e-mail to the registrar’s office. 
Once the registrar has invited you to view a file, you will receive an e-mail to let you know. Once you have registered for and/or logged in to regsol.be, you can find the closed file under the “My files” tab.

If you did have access to a file before it was closed, this file will remain accessible to you even after it has been closed. You can view the file in question in “My files”. 

Please note: to be able to view a closed file, ‘Also search in closed files’ under the “My files” tab must be ticked.

Depending on the role you have in a file, you can give or refuse access to people to one of your files. If you are, for example, the debtor, you can give access to one or more of your attorneys. 

  • First search for the file to which you want to give access. To do this click on the "My files" tab
  • Search for the file using the entry fields
  • In the list click on the file to which you want to give access
  • Click on the "Debtor/lawyer" tab
  • Click on the blue button "Add debtor/lawyer"
  • A pop-up appears. Fill in all the mandatory fields and then click on "Add"


If you are the debtor (or his attorney) in a judicial reorganisation procedure and a creditor requests access to your file, you give this as follows:

  • Open your file from the “My files” tab
  • Within your file go to the “Contacts” tab and to “Access requests”
  • To approve an access request, click on the tick next to the data of the creditor and to refuse it, click on the cross.
     

Notifications

  • Notifications in RegSol are communications intended for you, as a regsol.be user linked to one or more files in RegSol. These notifications are sent automatically by RegSol when certain conditions are fulfilled. No other users are involved in sending notifications. 
  • Notifications are visible to all members of your group. You can find them on your RegSol dashboard or in the detailed file view under the tab “communication”.

 
The notifications are communications or messages required by law. Other notifications inform you that a certain article, judgment, etc. is visible in the timeline.

 

Messages

  • A message is a communication posted by another party in a RegSol file and intended for your group.  Messages in RegSol never include any attachments.


Messages are only visible to the person who is designated as the default contact in a group. If you are the sole user in your group, you will automatically be designated as the default contact; this means you will be able to view any messages. The default contact person of your group will find his messages on his dashboard on RegSol or in the detailed file overview.
Look in “User management” to indicate the contact person within your group.

 

E-mails

You can select to be informed additionally by e-mail as soon as you receive a notification or a message in regsol.be. To do this: 

  • Click on your e-mail address on the top right and on ‘User management’
  • In the “Personal information” section click on the blue button “Change” and select there if you want to receive e-mails about the messages and notifications or when your user rights were changed


If in your ”User management” you have ticked the option “Receive notifications by e-mail?”, you will receive an e-mail overview once a day of all notifications received in your file that day. This e-mail will not be sent after every notification, instead it will only be sent once every day.

If in your “User management” you have ticked the option “Receive messages by e-mail?, RegSol will send you an e-mail if there is a message for you on regsol.be. 

Lastly, as a group administrator, you can opt, on their behalf, for your users to receive an email after filing a claim in a bankruptcy case. To do this, go to “User management” and click on the “Edit” button under the heading “Group data ”. There, tick the box “I want to receive an email after filing a claim in a bankruptcy case”. 

Sending a message

All regsol.be users who have access to a file can send a message via the file. 

Messages in regsol.be can be sent to

  • The receiver
  • The bankruptcy judge
  • The registrar 
  • The delegated judge (for JRP)
  • The debtor or the debtor’s attorney (for JRP only)
  • The court officer (for JRP)
  • The provisional administrator (for JRP)
  • etc.

 

To send your message, click on the file to open and go to the “Communication” tab and then click on “Messages”. To send a new message, click on “Send new messages”.

If you want to save your message temporarily and send it later, when creating your message click on “Save”. You will find the “temporary” message under the “Drafts” tab. You can always edit drafts and send them later.


 
Receiving a message

If someone has sent you a message, you will be able to see it under the “Messages” tab on your dashboard, and under the “Messages”/“Inbox” tab in the file in question.

Please note that you will only receive messages if you have been designated as the default contact for the group you belong to. If you are the sole member of your regsol.be group/account, you will automatically be designated as the default contact and will always receive any messages sent to you (or to your account).

You can set the default contact person for your group with the “Groups” tab in your “User management”

Would you like to receive an e-mail to inform you that there is a message waiting for you on regsol.be? Then click on your e-mail address on the top right, then on “User management”, in the “Personal information” section click on the blue button “Change” and tick there “Receive messages by e-mail?”.
 

When you submit a new file (a declaration of bankruptcy, a private or public JRP request, a request for a transfer under judicial authority or a request for approval of an amicable settlement), certain steps require you to add documents.

If you upload an incorrect document as part of one of these steps and want to delete it, you can do this as follows:

  • You can add a new document as part of the step in question. This document will then replace the incorrect document. 
  • You can continue to the next step and then go back – a trash icon will then be displayed next to all documents you have uploaded. If you click on the trash icon, the file will be deleted. 
  • You can also ‘Temporarily save’ the file. When you reopen the draft with “My files”, the trash icon will be displayed next to every document you have uploaded.

 
Note! Once you have submitted your file, you can no longer delete the documents you have uploaded.

When submitting a new file (filing a declaration of bankruptcy, a private or public JRP request, a request for a transfer under judicial authority or a request for homologation of an amicable settlement) and want to update several documents under one section, you can do this within the pop-up screen where you select your files. Select multiple files by using the Ctrl key on your keyboard.

Please note that if you add one document after the other, the previous document you uploaded will be replaced every time.

For security reasons, to limit the spread of viruses, you can only upload files of the following type or with the following extensions:.jpg,.jpeg,.tif,.tiff,.bmp,.txt,.doc,.docx, .xls,.xlsx,.csv,.pdf,.rtf,.png"

In case you wish to upload another document type, you must first convert it to a file of the above type.
 

The maximum size is 15 MB per file. You will receive an error message if the file is too large. If a PDF file is too large to upload, it can easily be made smaller by splitting it.
 
Splitting a file
We recommend you contact your IT department to split PDF files. If you do not have an IT department, you can install suitable software yourself. We strongly discourage the use of an online web service because of the sensitivity of the information.

You can find your provisional file under "My files" in the form of a "draft". You can open the draft and continue working on it until you wish to save the interim file again or until you wish to submit it. In case your session is interrupted during the creation of a file and you need to log in again, the last completed step of your file will also be saved and can be found under "My files". 

There can be several reasons for this: 

  • In a bankruptcy, “items” are sometimes only visible in the timeline once the registrar has dealt with them
  • In a JRP (public or private) items are only visible after the initiating party has passed the item on to the next party or sets it to OK. In concrete terms this means that the first private party must process the item for it to become visible for you, as public user 
  • You do not have reading rights to the item in the timeline

Bankruptcy

You submit your request for private preparation or declaration of bankruptcy by clicking on “Submit new file” and then clicking the relevant button – “Submit request private preparation of a bankruptcy” or “Submit bankruptcy declaration”. 

Go through the requested steps, and carry out an temporarily save if you do not have all the information at hand. You will find your draft file under “My files”. You can open the draft and continue working until you wish to save it again or until you can submit the file.

Only after you have completed all the mandatory fields in all the steps can you effectively submit your request for a private preparation or your bankruptcy declaration.
 

To submit your petition for a private preparation of bankruptcy, RegSol asks you to upload some documents.

  • If you are not the debtor of the file, you must upload a mandate 
  • The petition to request the private preparation of bankruptcy.
  • The accounting of the bankrupted, insofar as it is up to date. This concerns your balance sheet, income statement and statement of assets and liabilities 
  • Your list of creditors 
  • Your list of customers
  • Your list of staff members (if any)

 

In addition, it is best to have the following information at hand:

  • The personal and business details of the debtor
  • Documentation of any previous insolvency proceedings
  • The details of your centre of main interests or your accountant
  • The description and address of any immoveable property
  • The contact details of your social secretariat and your customer number
  • The personal details of your (possible) guarantor


 

To submit your bankruptcy declaration, RegSol will ask you to upload some documents. 

  • If you are not the debtor of the file, you must upload a mandate 
  • The accounting of the bankrupted, insofar as it is up to date. This concerns your balance sheet, income statement and statement of assets and liabilities 
  • The list of creditors 
  • The list of customers
  • The list of staff members (if any)

 

In addition, it is best to have the following information at hand:

  • The personal and business details of the debtor
  • Documentation of any previous insolvency proceedings
  • The details of your centre of main interests or your accountant
  • The description and address of any immoveable property
  • The contact details of your social secretariat and your customer number
  • The personal details of your (possible) guarantor

 

From the revision of Book XX, with effect from 01/09/2023, the remission will be requested automatically. You do not need to take any additional steps yourself. 

The “Declaration of bankruptcy” timeline is automatically “closed” after the bankruptcy judgement has been uploaded.

In concrete terms, this means you can no longer add items to the declaration once the opening judgement has been uploaded to the file. You can no longer upload items in closed timelines. However, you can add items to your bankruptcy timeline
 

Are you a Belgian legal entity?

You are required to submit your debt claim digitally via regsol.be.

 

Are you a Belgian natural person?

You can submit your debt claim digitally via regsol.be or in writing to the receiver

    • Contact the receiver who will provide you with the necessary documents for submitting your debt claim. The receiver’s e-mail address can be found via the 'Find files' button in the file's 'General information' tab. You need to create an account on www.regsol.be   

 

Are you a Belgian government institution?

You are obliged to submit your debt claim digitally.

 

Are you a foreign legal or natural person?

1. Are you represented by a special agent (lawyer, accountant, etc.)?

This person is obliged to submit your debt claim digitally via regsol.be.

2. Are you not represented by a special agent?

You can submit your debt claim to the receiver either digitally or in writing.

  • Do you wish to submit your debt claim digitally?

    Are you a creditor's authorised agent?

    As a lawyer, accountant, agent or other authorised agent, you can submit a debt claim on behalf of the creditor. As a third party who provides professional support, you are obliged to submit this debt claim digitally

    • Go to regsol.be and log in.
    • Find the desired file via the 'Find files' tab
    • Click on the file to open it
    • You can submit a debt claim via the 'General information' tab
       

    In order to submit your debt claim digitally, you will need:

    • all details relating to the debt claim (name and address, amounts, supporting documents such as invoices or contracts)
    • your personal details as a creditor (included in your account)
    • the account number for the payment of any dividends.
       

    Proceed as follows: 

    • Go to regsol.be and log in
    • Find the desired file via the 'Find files' tab
    • Click on the file to open it
    • Using the “General information” tab you can submit a debt claim as creditor or as authorised agent by means of the blue buttons

    • Go to regsol.be and sign up (you must first create an account on regsol.be if you don't already have one)
    • Find the desired file via the 'Find files' tab
    • Click on the file to open it
    • You can submit a debt claim as the creditor via the 'General information' tab

    • In the box “Composition of the amounts” you can enter the detailed composition of your claim, per section (privilege or not, nature of the privileges, etc.). To do this click on the plus button “Add extra amount” to enter an amount. For each amount you can create a new line with separate privileges.

    • After entering and uploading any additional information and accepting the conditions, in the bottom right click on the blue button “Submit”

     
    Once you have submitted the debt claim successfully, a green success message is displayed briefly on your screen. You will now find the debt claim under the “My debt claims” tab on the file with the status “Submitted”.

    • Go to regsol.be and sign up (you must first create an account on regsol.be if you don't already have one)
    • Find the desired file via the 'Find files' tab

    • You can submit a debt claim as an authorised agent via the 'General information' tab

    In the 'Composition of the amounts' box you can specify the detailed composition of your debt claim, per item (if there is a privilege, nature of the privilege, etc.): to do this, click on the plus button 'Add additional amount' to enter an amount. Create one line per amount with a separate privilege.

    • After completing and uploading any additional information, and accepting the Terms and Conditions, click on the blue 'Submit' button at the bottom right.

     

    If you have successfully submitted the debt claim, a green success message will briefly appear on your screen. You will also find a notification of this on your homepage. You can now find the submitted debt claim under the 'Debt claims' tab in the file with the status 'Submitted'.

    • You can look up a debt claim that has been submitted by your group using the 'My debt claims' button. Use the search filters and click on the blue 'Search' button to do a specific search.
    •  Alternatively, you can also first search for the file in question using the 'Find files' button or the 'My files' button and then click on the 'Debt claims' tab in the detail of the file.

    For each file for which you have submitted a debt claim, you have access to

    • the general information of the file under the "General information" tab
    • the debt claim declarations on the file, limited to the names of creditors, and the amounts claimed by them as laid down in the Code of Economic Law.
    • the documents uploaded by your group in the timeline, under the "My added items" tab
    • the documents (judgments, petitions and orders, official reports, etc.) belonging to the file for which you have the right of inspection - under the "Timeline" tab.

      When the documents were uploaded, you can consult:    
      • the bankruptcy order
      • the judgment determining the time of cessation of payments
      • the petitions of the liquidator
      • the decisions of the supervisory judge
      • the report on official visit to the site
      • the inventory report
      • the debt claim declarations, limited to names and amounts
      • the overview of claims
      • the list of settlements and approvals
      • the reports and distribution lists drawn up by the liquidators;
      • the simplified account.

     

    Note: 

    • You will find the debt claims you have submitted under the “Debt claims” tab and not in “My added items”. 
    • In the "My added items" tab, you will see the documents uploaded by you/your group as soon as you have created them. You will find these documents in timeline items when they have been handled by the court, the receiver, and the examining magistrate of the file and as long as you have read rights on the specific item where these documents were uploaded.


     

    You filed a debt claim declaration for a bankruptcy file, or you gained access to a file, allowing you to see not only the completed timeline of items, among others, but the debt claims as well. This allows you to see both the names of all creditors and the amounts of their claims. 
    This right of inspection is laid down by law in Book XX of the Code of Economic Law (WER). As soon as  

    • you file a debt claim declaration via RegSol.be, and you become a creditor in the file
    • access was granted to a file, in your capacity as third party or interested party 
    • you will have access to a bankruptcy file as a creditor 

     

    you will have access to all debt claims, both under the "Debt claims" tab and in the Timeline in article "XX. 164 report of verification of debt claims and table". This gives you access to the names of the other creditors and the amounts of their claims. 

    If you filed a debt claim declaration, you will see all the details of your declaration, with all attachments - but you will only see the names and the amount of the claim of the other creditors. The other creditors on the file will only see the same information about you and your claim. The details and attachments of your claim are therefore visible only to yourself, to the users within your account, and to the receiver. 

    The legislator established this visibility of all debt claims in this manner, to enable you to take cognisance of the totality of the liabilities and e.g., in accordance with the legal provisions, as a creditor you can object to the inclusion of another creditor's claim. 

    It is therefore legally correct for you to have access to data of (other) creditors, and this does not violate e.g. GDPR rules.
     

    • Go to regsol.be and log in.
    • Search for your debt claim using the 'My debt claims' tab or via the 'Debt Claims' tab in the detail of a specific file.
    • In the debt claim in question, go to the last 'Actions' column and click on 'Adapt the debt claim'.

    You arrive at a page that contains a brief overview of your debt claim.

    • At the top right, click on 'Adapt the debt claim'.

    You can edit your debt claim on this page.

    • "Composition of the amounts”
      • You can change amounts and add extra lines with new amounts using other privileges.
      • You can make changes as long as the receiver has not yet processed all the lines of your debt claim. 
      • If the line of the debt claim was submitted provisionally, you can also still change the amount submitted for this line. 
      • Note: If the receiver has already processed certain parts of your debt claim, you will no longer be able to change all fields. These fields will then be coloured grey and can no longer be edited.
    • “Bank details”
      • Before proceeding with the payment of any claim, the receiver must have the correct bank details.
      • Under the “Bank details” section, click on the plus button “Add account number”. 
      • Fill in the necessary details such as the account holder’s name, IBAN, and BIC. 
      • If it is a foreign account, untick the “Is a Belgian account number” box and fill in the additional details of your financial institution. 
      • Click “Save”.

     

    After you have made the desired changes, in the bottom right click on “Adapt debt claim” to save your changes.

    Go to regsol.be and log in.
    Look up your debt claim:

    • via the button 'My debt claims'
    • or via the buttons 'Search for file' or 'My files' and then click on the 'Debt claims' tab in the detail of the file.

     
    In the results list, you can view the 'Status' of your debt claim in the 2nd column:

    • To be submitted: you have an unsubmitted draft of a debt claim for this file
    • Submitted: you have a debt claim in this file. The receiver has yet to process this.
    • In progress: the receiver is processing your debt claim, you can no longer change certain lines.
    • Qualified: your debt claim has been qualified, view the Review Statement in the timeline.
    • Rejected: Your debt claim has been rejected by the receiver. You can find the reason for rejection in your notifications on the homepage.
    • Withdrawn: you have withdrawn this debt claim from this file. In the 'Actions' column you will find the actions that you can perform.

     

    Please note: you can only consult the qualification (held, accepted or disputed) of your debt claim in the Review Statement. You will receive a notification when the Review Statement has been uploaded to the file. You can find the Review Statement under the 'Timeline' tab in the file's detail.
    Timeline

    The qualification (held, accepted or disputed) that the receiverhas given to your debt claim can only be consulted in the Review Statement. 

    For files that fall under the application of Book XX, the first Review Statement is drawn up approximately two months after the bankruptcy file is opened. A second Review Statement follows six months after the date of the bankruptcy, and a third and final Review Statement after one year.

    You will receive a notification when the Review Statement has been uploaded to the file. You can find the Review Statement under the 'Timeline' tab in the file's detail.
     

    You can consult the reason for rejection:

    • in the Review Statement (if you still have access to the file in another capacity)
    • in your notifications on the homepage of regsol.be

    You can only view the PDF and attachments of a debt claim:

    • if you are a debtor or lawyer of the debtor for a file
    • if you hold a special capacity for which the law stipulates that you have access to certain information
    • if it concerns a debt claim that you or another user of your group has submitted

     

    Proceed as follows:

    • Go to regsol.be and log in.   
    • Find the file in question via the 'Find files' or 'My files' tab and open the 'Debt claims' tab  

     
     

    Alternative: click on the 'Access my debt claims’ button on the regsol.be homepage and select the desired debt

    • The overview list of debt claims opens.

    Click on the icons below in the last column, 'Actions', to download the PDF of the submission and the attachments to the debt claims. Your PDF declaration contains an additional statement of the exact date and time of submission

    If these icons are missing from the 'Actions' column then there are no attachments to consult.
     

    You can continue to edit a provisionally filed (line in a) claim. The receiver will be notified if you adjust the provisionally submitted amount after the receiver has already processed this line. Once you have definitively budgeted the amount, please untick the "provisional" box.

    Please note that the receiver will make a final decision on your claim in the 3rd Review of Insolvency of your claim. Changes after the third “Overview of claims” are no longer included in the receiver’s decision.
     

    Debt claim in an open file
    If you wish to change your debt claim, you will notice that certain fields are greyed out and that, in some cases, the 'Composition of the amounts' box is also missing the 'plus button' that usually allows you to add an extra amount to the debt claim.
     

    Composition of the amounts
    In 'Composition of the amounts', you can only amend lines of your debt claim that the curator has not yet processed. If you have entered the amount of your claim provisionally, you can still adjust it for this line.
    But once the curator has edited all the lines in your claim with the final amounts, you cannot make any changes in the framework "composition of the amounts". You can’t add no more extra amounts on your debt claim.

    You can only consult the decision of the bankruptcy curator in the Review Statement. You can find the Review Statement in the file's 'Timeline' tab. You will receive a notification when the Review Statement is uploaded.

    • If you still wish to change the amount of a debt claim, even if this is no longer possible via regsol.be, you will have to contact the bankruptcy curator.
    • If you only wish to add an amount to your debt claim, you can submit a new debt claim for this in the file.

     

    Debt claim in a closed file
    You can no longer edit your debt claim in a closed file. You will find fewer icons in the 'Actions' column than are shown for an open debt claim file

    • In the detail of the debt claim, the button 'Change debt claim' will no longer appear.
    • In the detail of the debt claim, in the top left next to the name of the file you will find a red mark labelled 'Closed'.
    • You can no longer transfer your debt claim in a closed file.
    • You can no longer withdraw your debt claim in a closed file.
       

    You can transfer your debt claim to another creditor, to someone else in your group or to someone else in your account, provided that the transferee has an account on regsol.be.

    • Go to regsol.be and log in.
    • Find the debt claim you want to transfer under the ‘My debt claims’ tab
    • In your debt claims list click in the “Actions” column on the double arrow “Transfer your claim ”

    • Select the correct group and user and click on 'Transfer' 
      • After transfer, the debt claim will be visible to the new creditor/in the new group to all users within that group.
      • After transfer, the e-mail address on the debt claim (visible to the liquidator) will be the e-mail address you select from the drop-down.
    • The debt claim no longer appears in your 'My debt claims' list after transfer.

     

    Please note: you can also transfer a debt claim to a colleague within your own group. In practice, however, this only changes the e-mail address that appears on the debt claim for the liquidator. You will still find this debt claim in the 'My debt claims' list as this list contains the debt claims submitted by all of your group's users.
     

    You can transfer a single debt claim, but you can also transfer several debt claims in one operation.  

    The conditions for transferring a batch of debt claims are:
    •    the group to which you are transferring the debt claim already has a group itself on regsol.be
    •    the selected debt claims must have the action button “Transfer your debt claim”

     
    Proceed as follows:

    • Go to regsol.be and log in
    • Click on the 'My debt claims' tab
    • In the list, select all the debt claims that you want to transfer. To do this, tick the checkbox in front of the debt claim. The selected debt claim turns blue.
    • In the top right of the results list click on the “Transfer in bulk” tab.

    • •    Select to whom you wish to transfer the batch of debt claims 

     

    If you want to transfer a batch of debt claims within your own accounts:

    • Select “To a colleague  ” in the options menu
    • Enter the company number of your company
    • Select the correct group and the correct user
    • Click on “Transfer”

     
    If you want to transfer debt claims to a new creditor or an authorised agent outside of your account:

    • Select 'To a creditor or an authorised agent' from the drop-down menu
    • Enter the recipient's company number or national registry number
    • Select the desired group
    • Click on “Transfer”

     
    If you are unable to select the desired group: contact the person to whom you want to transfer the debt claims and ask them to create an account on regsol.be.
     

    A submitted debt claim cannot be deleted. 
    If you no longer want to maintain the submitted debt claim, you can it using the 'Withdraw' button in the 'Action' column in the list of debt claims:

    Please note: if you withdraw a debt claim, you will no longer have access to the file as a creditor. If you still want to follow the file, you must request access as a third party.

    If the liquidator has prepared a tax certificate for a debt claim, you will receive a notification of this. You can find the notifications on the home page under ‘Notifications’ or on the detailed file overview under the ‘Communication’ button. 

     

    • Sign up at regsol.be
    • Go to the file in question via the 'My files' tab.
    • Open the 'Debt claims' tab
    • You can then download the tax certificate by clicking the action button in the penultimate column 'Tax certificate'.

    For each file for which you have been granted access rights, you have access to:

    • the file's general information under the 'General information' tab;
    • the debt claims declarations in the file, limited to names and amounts
    • the items (declarations, documents, judgements, official reports, etc.) that belong to the file and for which you have access rights – under the 'Timeline' tab. 

     

    For example, you can consult:    

    • the bankruptcy order, 
    • the judgment determining the time of cessation of payments;
    • the petitions of the curator
    • the decisions of the examining magistrate;
    • the site inspection report;
    • the inventory report;
    • the debt claim declarations, limited to names and amounts;
    • the debt claims Review Statement;
    • the list of settlements and approvals;

    Your access rights are governed, with regard to old bankruptcies prior to 1 May 2018, by the Bankruptcy Act of 8 August 1997, and thereafter by Book XX Insolvency of Companies, and its implementing decrees.

    Please note: with regard to bankruptcy files, you can only consult the documents being processed by the court after they have been dealt with by the various actors (curator, examining magistrate, registry) and have been finalised by the registry. 

    In the 'My added items' tab you can consult the documents uploaded by your own group before they have been processed by the different actors. 
     

    Judicial reorganization procedures

    To submit your petition for public judicial reorganisation, RegSol will ask you to upload some documents. 

    • If you are the debtor of the file, or his proxy, you must upload a mandate.
    • Your petition to request the judicial reorganisation procedure. You can also add a request for suspension of sales to this.
    • Your list of creditors, preferably managed in the RegSol module.
    • Possibly, your petition for the appointment of a restructuring expert.
    • The additional documents, as provided for in Art. XX. 41 §2 WER.

     

    In addition, it is best to have the following information at hand:

    • The personal and business details of the debtor.
    • The business details of any affiliated companies.
    •  Information regarding employees, real estate and surety agreements.

     

    To submit your petition for private judicial reorganisation, RegSol will ask you to upload some documents. 

    • Your petition to request judicial reorganisation.
    • Your list of creditors, preferably managed in the RegSol module  
    • An explanation of the events
    • The 2 most recent annual accounts or 2 most recent personal tax returns 
    • Any other documents you wish to add to the file


    In addition, it is best to keep the debtor’s personal and business information at hand.
     

    On the regsol.be dashboard, you can choose between “Submit petition for public judicial reorganisation procedure” and “Submit petition for private judicial reorganisation procedure”. Go through the requested steps, and carry out an interim save if you do not have all the information at hand. You will find your draft file under “My files”. You can open the draft and continue working on it until you are ready to submit the file.

    It is only after you have completed all mandatory fields in all steps and paid the fee that you can effectively submit your petition for a judicial reorganisation procedure. You must take into account that a further payment must be made to the Commercial Court. You will immediately receive a payment invitation for this.

    You will find your draft file under “My files”. You can open the draft and continue working until you wish to save it again or until you can submit the file.

    You can choose to create the list of creditors according to the RegSol module from the moment you submit your petition. In this case, tick the checkmark to use the RegSol module to manage your creditor list.

    If you choose to upload your own list, and the court decides that electronic voting or remote voting is possible on your file, you will receive an e-mail from RegSol to manage your list of creditors via the module. Only then will electronic voting be effectively possible. 

    You will find the Creditors module under the “Debt claims” tab on the detail of your file. The list is not created or supplemented by the registry.

    Add individual creditors using the plus buttons. 

    • Enter the details of the creditor 
    • Create categories of claims (if this concerns a public Judicial Reorganisation Procedure for a large company)
    • Fill in the details and add files 
    • Click on “Save” at the bottom right 

     
    Important: Using the RegSol List of Creditors module if you submit a petition for Collective Agreement is an absolute condition for: 

    • later electronic voting concerning the reorganisation plan 
    • the use of the notifications generated by RegSol that you as a debtor can send to your creditors.

     

    These letters contain a unique code with which your creditor can register in the file. This creditor registration is necessary in the event of an electronic vote on the reorganisation plan.

    Once the procedure has been granted, you can use the Creditors module to generate notifications. This letter contains a strictly personal (QR) code for the creditor. You can make a choice of sending the letter either by paper or e-mail. This is the only option for the creditor to access the file and link to his/her claim. The creditor will only be able to vote on the reorganisation plan electronically in the case of a Collective Agreement if he/she is linked to his/her debt. 

    To generate these notifications, proceed as follows:

    • Go to your file on regsol.be and go to the “Claims” – “Creditors” tab
    • The list of your creditors can be found there
    • After the opening judgement of your “Collective agreement” file you have the option to generate the notifications in 2 ways
      • Go to a creditor’s line and click on the blue “Generate notice button. Your notice for this individual creditor and the list of creditors to be attached will be downloaded.
      • Or click on the blue “Generate all open notices button. A zip file containing all the individual notices and the list of creditors will be downloaded. 
        To print these all at once, open the zip file and copy the documents into another local folder. Select all the files in this folder and right-click, then select “Print”

    Proceed as follows:

    • Log in to your account on regsol.be
    • Search for the relevant file under the “Search files” tab. In the subsequent screen, select “Judicial reorganisation” instead of “Bankruptcy”
    • If you have accessed the file previously, you will find the file under the “My files” tab
    • In both cases, click on the file. The “General information” tab of the file opens
    • In the right bar, scroll to the: “Dept claim declaration interrupting the limitation period” section and click “Uploading debt  claim”

    You will find your submitted statute of limitations debt under the “My added items” tab.

    NB: Submitting a statute of limitations declaration has no consequences on the composition of the list of creditors in the Judicial Reorganisation Procedure.

    Comment: 
    You do not automatically get access to a file when you upload a statute of limitations debt. You must submit an access request for the file. The option to declare a statute of limitations debt is therefore separate from your access to the file. 
     

    The “Request Judicial reorganisation procedure” timeline is automatically “closed” after the judgement for opening the procedure has been uploaded.

    In concrete terms, this means you can no longer add items to the request after the opening judgement has been uploaded to the file. You can no longer upload items in closed timelines. 
     

    This can be due to several causes: 

    • In a judicial reorganisation procedure, items are only visible after the starting actor passes the item on to a subsequent actor or sets this item to OK. In concrete terms, this means that when you add a new item to the file, a private actor (e.g. a delegated judge) must first process the item before it becomes visible in the public section. 
    • You do not have reading rights to the item in the timeline

    Transfer Under Judicial Authority

    To submit your request for a transfer under judicial authority, RegSol will ask you to upload some documents. 

    • If you are an authorised representative of the debtor in the file, you must upload a mandate
    • Your request for the transfer under judicial authority. You can also add a request for suspension of sales to this
    • Your list of creditors, whether or not managed in the RegSol module
    • The last 2 annual accounts
    • The additional documents, as provided for in Art. XX. 41 §2 WER
    • In addition, it is best to have the following information at hand:
    • The personal and business details of the debtor
    • The business details of any affiliated companies
    • Information regarding employees, real estate and surety agreements
